Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and picstack (“we”, “us”, “our”) governing your use of the picstack mobile application (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old, or have the consent of a parent or guardian, to use the App. If you use the App on behalf of someone else, you confirm you are authorised to do so.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, for your own personal use, subject to these Terms and the app store’s terms.
3. Privacy
Our Privacy Policy explains how we handle information. By using the App, you also agree to our Privacy Policy, available here.
4. Your photos and your responsibilities
- You retain all rights to the photos you use in the App. The App processes your photos on your device; we do not receive a licence to, or a copy of, your photos.
- You are solely responsible for the images you use. You represent and warrant that you have all necessary rights and consents to use them, and that your use does not infringe anyone’s rights or any law.
- You must not use the App to create or share content that is unlawful, infringing, defamatory, harassing, or that depicts a person without their consent, or that is otherwise harmful or objectionable.
5. Acceptable use
You agree not to: reverse engineer, decompile, or attempt to extract source code (except to the extent permitted by law); interfere with or disrupt the App; or use the App in violation of any applicable law.
7. Purchases, billing, and cancellation
- Purchases are processed by the Apple App Store or Google Play, and are subject to their terms. Payment is charged to your store account.
- The monthly subscription automatically renews at the then-current price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store / Google Play account settings. Removing the App does not cancel a subscription.
- “Lifetime” access means access to premium features for the lifetime of the picstack product/service, not a guarantee that the App or any feature will be available indefinitely. If we discontinue the App or a feature, or if it becomes impractical to provide it (for example due to platform changes), lifetime access may end.
- Refunds are handled by Apple or Google under their policies, and as required by law (including the Australian Consumer Law, see section 10).
8. Intellectual property
The App, including the “picstack” name, logo, design, and software, is owned by us and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.
9. Disclaimers
The App is provided “as is” and “as available”. To the maximum extent permitted by law, we do not warrant that the App will be uninterrupted or error-free, or that subject lifting or any output will meet your expectations. The App requires iOS 17 or later or Android API 24 or later; some features rely on device hardware and operating-system capabilities.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law (ACL) or other law that cannot lawfully be excluded. Where our liability for failing to comply with a consumer guarantee can be limited, our liability is limited (at our option) to re-supplying the relevant services or paying the cost of having them re-supplied.
11. Limitation of liability
To the maximum extent permitted by law (and subject to section 10), we will not be liable for any indirect, incidental, special, or consequential loss, or loss of data or profits, arising out of or in connection with your use of the App.
12. Apple App Store
These Terms are between you and picstack only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content. Your licence to use the App is limited to a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service. Apple has no obligation to provide any maintenance or support for the App. To the extent any warranty is not effectively disclaimed, you may notify Apple and Apple will refund the App’s purchase price (if any); Apple has no other warranty obligations. We, not Apple, are responsible for addressing any claims relating to the App, including product-liability, legal or regulatory, and intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and that you are not on any U.S. Government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
Google Play equivalents (including any Google Play–specific acknowledgements) will be added before the Android launch; picstack is iOS-first.
13. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using the App at any time. Sections that by their nature should survive termination (including 4, 8, 9, 10, 11, 12) will survive.
14. Changes
We may update the App and these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where required, provide additional notice. Continued use after changes means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place, without limiting any rights you have under the Australian Consumer Law.
